Surely they can charge him with some form of assualt and there will be evidence of that where the crash occurred - debris on the wrong side of road, skid marks etc.
As I said glad you are okay.
Hope not to pry but you mentioned smoke - do you know the source of that and did it end up actally alight ?
police took my car for forensics, his car was maroon......and so there was paint marks on my passenger side. There was debris from his car....on the right hand side of the right hand lane......his wingmirror came off...and you can see my wheel marks going off onto the grass........my front driver tyre came off as it hit the grass humps and you can see clearly the wheel marks going from the verge into the ditch....but despite all this....police say that, it is unwitnessed, and in court it would be his word against mine......which counts for nothing.

What is the point of getting evidence if it has to be witnessed ? Might as well get rid of all the coppers and just have lawyers and witnesses then. CRAZY !!!! If you wanted to push it I would be a pain and shame them into a prosecution - this guy tried to kill you and needs to be punished !!!!! The fact that the collision occured on the wrong side of the road with no witnesses ie he wasn't overtaking somebody so he swerved to either push you off the road or to stop you overtaking - reckless driving at the very least, no doubt dangerous driving and almost certainly a criminal offence of assualt. I can understand you wanting to put this behind you though and that is what the police / cps rely on to make their life easy and keep the prosecution success rate up - they don't want to take risks in case they are accused of wasting time / money regardless of what is right.

what a scumbag, so many people drive without a license and no insurance because there is little or no punishment for it. Knowing what this country is like if the person does get some sort of punishment it will probably be a small fine and points on a license they have not even got you see it all the time on those police programmes.
Glad to hear you are ok though if it was me in your position I would be very angry that someone would do that and then be able to get away with it to do it again.

Just read your story in absolute shock. I'm so sorry for you, it must have been awful. Glad to hear you are OK though and made it out in one piece. I hope the dirtbag gets what he deserves

This is totally shocking, the good thing is that you're ok and the cars safety systems did their job. It scares the life out of me to think how many unlicensed (untrained) and uninsured drivers there are, and watching Traffic cops on BBC 1 last night proves that they get little or no punishment when they get caught.  Again, I hope you are ok and the insurance company doesn't take too long to get you back on the road with a new A500

WOW, glad you're O.K.  Hope they catch the scum bag quickly. Is the car badly damaged? unfortunately...yes, i think just about every part of the car was damaged. It would be a 'trigger's broom' if repaired.

My God what an experience for you, it must have been very scary!
The most important thing is that you were not seriously injured.
Thought you were going to say he pulled across you to avoid something, what kind of person does something like that deliberately?
Yeh i was petrified, i really though my time was up. It is incomprehensible to imagine that someone would go to those lengths to avoid being overtaken, (by a woman), the only thing that i would concede to, is that maybe he just meant to frighten me, but misjudged (or lost control) of his swerve into me, however the collision was quite a crunch, not just a little brush.

OMG - that's terrible. I hope they catch the scumbag and give him whats what but more likely he will get a slap on the wrist and lots of tea and sympathy.
You never know though - he may turn up on your ward needing your help tee hee....
Glad you are okay.
police said he has driving ban, will prob have a fine and maybe a tag or something, however.....he didn't have the right to drive anyway, and that didn't stop him. fortunately....(i think)....i don't know what he looks like. So would never know if he was my patient

Poor Potty thank goodness you're ok, terrible news about the car and I hope after that little performance you'll stick with us and go through the pain of getting another. We could do with a hug icon for these moments.
aww thanks chris... if car is write off, i think insurance will replace with new, as under 1 year, so will have the wait again. in the meantime....i am proud new owner of P reg Peugot 106, 117, 000 on the clock, bright green......  cost less than 8oo quid to buy and insure, to tide me over till this is all resolved... insurance policy says it replaces with exactly what you have.

Pottygirl Really sorry to hear your bad news but most importantly that you are OK. It would appear also that people where you live are very public spirited which it would seem has significantly helped you.
It is amazing when reading your first post the detail you can remember when you have an accident. I remember many years ago when I rolled a car ending up on the roof after someone who also drove off cut in front of me and i ended up sliding along on the roof not knowing if i was over in a field still by the road or in the road but i can remember undoing my seat belt droping down after smelling petrol and thinking that this is probably not the best place to be i did though remeber to pick up my calculator which had droped out of my jacket pocket (i needed it for work the next day!!).
It is good to hear that the EuroNCAP rating for the 500 is justified. Now it is the pain of waiting for a new one again.
Again great to hear that you are in one piece.

Gap cover would make up the difference between the insurance payout and the original purchase price of the car. Martin is right about new for old in the first year but not all insurance companies do that, you have to check the small print.

Good God! What an awful story. I'm just glad you are ok. It sounds to me as if the little car was a real hero here, keeping you safe.
If the scumbag was driving whilst banned, I wouldn't rule out a custodial sentence. He sure deserves it.
